ADULTRELEASE OF LIABILITY, ASSUMPTION RISK AND PARENTAL AGREEMENT

In consideration of being permitted to participate in the wall climbing & rappelling activities (“The Wall” Rappelling and “The Rock: Climbing Wall) at Adventure Zone for myself, my personal representatives and heirs, (1) I acknowledge, agree and represent that I understand the nature of the activity, that I am in good health and qualified to participate in the activity and if I believe the conditions to be unsafe, will discontinue participation, (2) I understand that this activity involves risk and dangers of serious injury, including permanent disability and even death and these risks may be caused by my own actions, or the actions or inactions of others participating in the activity, the conditions in which the activity takes place, the negligence of the “releases” named below or other unforeseen exposures.  

I also fully accept and assume all such risks and responsibility for any loss, cost or damages I may incur as a result of my participation in the activity,  (3) I hereby release, discharge and covenant not to sue Adventure Zone, it’s administrators, agents, officers, volunteers, employees, other participants, and independent contractors from all liability claims, demands, losses or damages caused or alleged to be caused in whole or in part by the negligence of the “releases” or otherwise, including negligent rescue operations.

 I further agree that if I or anyone on my behalf makes a claim against the releases, I will Indemnify, save and hold harmless each of the releases from any litigation expense; attorney fees, loss, liability, damage or cost which they may incur.

I am eighteen (18) years of age or older and have read and understand the terms of this release and understand I am giving up substantial rights by signing this agreement and am signing it voluntarily without any inducement.

MINORRELEASE

I, a minor, the minors parent and/or legal guardian understand the nature of the climbing wall activity and the minors experience and capabilities and believe the minor to be qualified, in good health and proper physical condition to participate in this activity.

I hereby release, discharge and covenant not to sue, and agree to indemnify and hold harmless each of the releases from all liability, claims, demands, losses or damages on the minors account caused or alleged to be caused in whole or in part by the negligence of the releases or otherwise, including negligent rescue operations, and further agree that if, despite this release,  I, the minor or anyone on the minors behalf makes a claim against the releasees, I will indemnify, save and hold harmless each of the releases from any litigation expense, attorney fees, loss liability, damage or cost which may occur.
